Handling Trade-Related Claims and Disputes
One of the most important areas of activity of any major Chamber of Commerce is the settlement of trade claims.
The Japan Commercial Arbitration Association (JCAA) was established in 1951. It has five offices in the cities of Tokyo, Yokohama, Nagoya, Osaka and Kobe. This organization is the only body set up to handle commercial disputes in Japan. It enjoys official recognition from both the Japanese government and foreign arbitration communities. In Kobe, the KCCI acts as a branch office of JCAA. We treat disputes mostly at a consultation level. That is, we encourage the disputing parties to meet again to continue negotiations, and often have them reach an amicable agreement.
For more difficult cases, we try to step in between the parties and let each of them review the steps already taken. We attempt to make them aware of the problems involved and the causes of the dispute. As a final step, we urge them to settle the case through formal arbitration.
When arbitration takes place, the two parties have to agree in writing beforehand to accept that decision as final and conclusive. We have only a few cases a year of arbitration throughout the five offices of the JCAA.
